Expertise

Other areas

Civil law, administrative law and specific needs.

In a few words

Beyond its main areas, Étude Agerba advises on civil and administrative law and assists on a one-off basis in other matters.

Each enquiry is examined on its own merits. If your matter falls in an area the firm does not practise, we tell you at the first contact. Family law, a divorce for example, is not one of them. Where a divorce has a strong tax component, such as dividing a business or substantial assets, the firm can nevertheless act.

Civil law
Contracts, liability, neighbour relations and disputes between private parties.
Administrative law
Decisions by authorities, permits, procedures and appeals.
Referral
To a trusted colleague when that is the better option.

Our approach

A clear answer, even outside the main areas

A contract question, a dispute with a neighbour, an administrative decision: each enquiry is analysed on its own terms. We first tell you whether the firm is best placed to help.

When the matter falls in an area the firm does not practise, we refer you to a trusted colleague. When it spans several areas, we coordinate the work with the other advisers involved.

In Neuchâtel, civil disputes go to the regional courts, usually after an attempt at conciliation, and administrative decisions can be challenged up to the Cantonal Court.

What is at stake

Three useful reflexes

  1. 01

    Keep the documents

Contracts, correspondence, invoices, decisions: written documents are often the best evidence. Keep them as soon as a dispute takes shape.

  2. 02

    Check the deadlines

An administrative decision normally states how and within what time it can be appealed. The deadline is often 30 days, sometimes less, and it cannot be extended.

  3. 03

    Write before you act

A clear formal notice before any proceedings often settles the matter, or usefully prepares what comes next.

Law and tax

The tax reflex

Even in a civil or administrative dispute, a settlement, compensation or a transfer of property can have tax consequences. We point them out before you sign.
